By accessing or using the ObservableAI platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

ObservableAI provides enterprise observability and governance tools, including telemetry ingestion, operational dashboards, compliance evidence, audit trails, and related analytics services. The specific features available to you depend on your subscription plan.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access to or use of your account.

4. Data Ownership

You retain all ownership rights to the data you submit to our Services ("Customer Data"). We do not claim ownership over Customer Data. We process Customer Data only as necessary to provide the Services and in accordance with our Privacy Policy.

5. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Transmit malicious code or interfere with the Services
  • Attempt to gain unauthorized access to any part of the Services
  • Use the Services to develop a competing product

6. Service Level Agreement

Enterprise plan customers may receive a Service Level Agreement (SLA) defined in their Enterprise agreement. Details of the SLA, including service targets and credit policies for downtime, are provided in that agreement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ObservableAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

8. Modifications

We may modify these Terms from time to time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after any modifications constitutes acceptance of the updated Terms.
